Three years ago, a semi truck jackknifed on state Route 12 in Sacramento County, colliding with the bus that Debra L. Hackett was driving and paralyzing her from the waist down.

The crash, which also caused skull fractures and injured Hackett’s spinal cord, limited her ability to interact with her four children and husband. She had to spend more than half of each week in a convalescent facility.

Her experience was a sympathetic one for a jury, except for one big hurdle — Hackett wasn’t depressed. Her family visited often, and she received satisfactory treatment from her doctors. She got to visit home three days a week and go to church on Sundays.

The retrieval rope broke under high wind conditions, which were consistently in excess of the ZipRider’s operational parameters in the hours before Mark Dickson’s death. Heavenly’s poor maintenance of the rope also contributed to its failure. In the months prior to the accident, Heavenly abandoned the inspection practices mandated by the ZipRider’s manufacturer. On the day Mark Dickson died, the ZipRider was understaffed and no supervisor trained in the ride’s operation was present to ensure that safety procedures were being followed.

Automotive Experts Retained In A Potential Automotive Defect Case


Chris Wood has already retained a top automotive expert to inspect the vehicle to see what went wrong and caused Mrs. Chaudhary to lose control and leave the roadway. This inspection will follow the California Highway Patrol’s MAIT team inspection, which has already concluded, but the results have not yet been released. There should be sufficient physical evidence and information from the black box to shed light on whether the accelerator pedal stuck and contributed to the incident.

Roger Dreyer, 2013 Consumer Attorney Of The Year Finalist


A Ford Econoline E-350 van owned by a church went out of control and rolled over four times after a catastrophic right rear tire tread separation. The driver and front-seat passenger were killed and another passenger was injured. The attorneys showed that the tire that failed had been recognized by the National Highway and Traffic Safety Administration as having a very high incidence of catastrophic failures, and the NHTSA had determined the E-350 had a high propensity for rollovers after catastrophic failures of this particular tire. Goodyear, the tire’s manufacturer, conducted its own investigation and ultimately stopped making the tire in 1999. Ford knew about the NHTSA’s investigation and Goodyear’s discontinuation of the tire, but it never communicated to its E-350 owners or its dealerships that the tire was defective and dangerous. Key Ford executives testified that they didn’t notify dealers about the Goodyear tire problem because they saw it as a “Goodyear campaign” and Goodyear never asked Ford to be involved. The attorneys showed this contradicted Ford’s behavior in nearly a dozen prior recalls of other tires, in which Ford often spent millions of dollars in proactively notifying its customers. A jury awarded a substantial verdict, including punitive damages against Ford.
