Defense argued plaintiff had been up and down the stairwell over 1,000 times, and he was intimately familiar with the stairwell because it was just outside his office door. In addition, defendant argued that plaintiff had fallen previously and complained to his brother-in-law that he had fallen and was having back pain just days before the subject fall. Plaintiff’s brother-in-law testified that plaintiff had back pain before the fall and, in fact, was complaining of back pain minutes before the fall. The case ultimately settled for the policy limits of $1 million.
