$3.4 Million Settlement Reached In Delivery Vehicle Accident

Verdict: $3.4 Million | EI Dorado County | Rebello v. Vitas Healthcare Corporation
Defendant driver of Vitas Home Health delivery vehicle failed to yield the right of way and turned directly in front of an oncoming vehicle, causing catastrophic injuries that resulted in the death to Jack Rebello, age 82. Plaintiffs were his wife of 62 years, son and adult grandchildren. Despite clear evidence downloaded from the vehicle computers showing that the Vitas vehicle was the cause of the collision, defendants denied liability and claimed that decedent was speeding and should have been able to avoid the collision.
In response, plaintiffs’ counsel collaborated with the El Dorado County District Attorney’s Office on an investigation which resulted in the prosecution of the defendant driver and a guilty plea.
After hearing voluminous testimony of his dedication and commitment to family, and service to the community throughout his lifetime, close to trial the defendants reversed position and accepted liability. After participating in private mediation and Settlement Conference, the matter resolved by way of defendants agreeing to pay $3.4 million in an attempt to compensate the family for their loss of love and companionship. There was no claim of economic damages for loss of income or benefits.
