Jury Finds In Favor Of Motorcyclist In Freeway Accident

Verdict: $1.25 Million | Sacramento County | Stubbs v. Aslett

On Thursday June 9, 2016, a Sacramento County jury returned a verdict in favor of motorcyclist Timothy Stubbs. Mr. Stubbs was seriously injured in a June 30, 2014 motorcycle versus pickup truck accident that occurred on the interchange from westbound Interstate 80 to southbound Interstate 680.

Plaintiff Timothy Stubbs was represented by attorney Joseph J. Babich of Dreyer Babich Buccola Wood Campora, LLP. Defendant was represented by attorneys Peter J. Hirsig and Brendon L.S. Hansen of McNamara, Ney, Beatty, Slattery, Borges & Ambacher, LLP.

At the time of the accident 47 year old Timothy Stubbs was driving his Harley Davidson Street Glide motorcycle to Walnut Creek where he was employed as a union journeyman plumber for Benicia Plumbing. As he was traveling through the interchange from westbound Interstate 80 to southbound Interstate 680, traffic abruptly stopped causing defendant Robert Aslett to abruptly move his pickup truck from the left lane into the right lane in order to avoid hitting the vehicle stopped in front of him. Unfortunately, Mr. Stubbs, who was traveling in the right lane, did not have time to stop his motorcycle before it collided with the rear of Mr. Aslett’s pickup truck.

The defense denied fault and hired four experts in an effort to establish that Mr. Stubbs was lane splitting, traveling too fast for the conditions and not reacting to the danger in front of him. After a five day trial the jury soundly rejected the defendant’s efforts to shift fault and ultimately found Mr. Aslett to be fully at fault resulting in a $1,250,000 verdict.
